1. Without provisions prohibiting accumulation the insured would not be indemnified until the qualifying period for a claim relating to the transfer risk had elapsed.

Ohne das Kumulierungsverbot würde der Garantienehmer erst dann entschädigt, wenn die Karenzfrist für das Transferrisiko abgelaufen wäre.

2. The unlawful act arises when and if the enriched party refuses to reimburse the impoverished party (action de in rem verso) or the principal refuses to indemnify the manager (negotiorum gestio).

Zu einer rechtswidrigen Handlung komme es erst, sobald und wenn sich der Bereicherte weigere, die Bereicherung an den Entreicherten herauszugeben (actio de in rem verso), oder der Geschäftsherr es ablehne, den Geschäftsführer zu entschädigen (negotiorum gestio).

3. [Consultban] and [the applicant] agree that in the event [the applicant] requests the cancellation of this contract for reasons not covered as per the terms of the contract, and [Consultban] is obliged to indemnify owners as per the terms of COA [Contract of Affreightment] between the owners and [Consultban], then [the applicant] to indemnify [Consultban], upon first request in writing up to the amount of USD 1 000 000, provided adequate proofs are presented by [Consultban].

"[Consultban] und [die Klägerin] vereinbaren hiermit für den Fall, dass [die Klägerin] die Aufhebung dieses Vertrages aus anderen als den darin vorgesehenen Gründen verlangt, und [Consultban] den Eigentümern gegenüber gemäß dem COA [$Contract of Affreightment`, Frachtvertrag] zwischen diesen und [Consultban] schadensersatzpflichtig wird, dass [die Klägerin] [Consultban] auf deren erste schriftliche Aufforderung Ersatz bis zu einer Höhe von 1 000 000 USD zu leisten hat, sofern [Consultban] entsprechende Beweise vorlegt."

4. 5. 2.4 The above being understood, the User will be responsible for any use, made by third parties, authorized or not authorized, of the above-mentioned passwords and usernames, as well as of any damage caused to Paolo della Santa and/or third parties, due to the non-observance of the afore-said, and promises, from hereon, to indemnify Paolo della Santa from every and any request, even for compensation of damages, deriving directly or indirectly, from the above-mentioned use or abuse.

2.4 Unabhängig von den oben genannten Klauseln ist der User für jeden autorisierten oder nicht autorisierten Gebrauch des oben genannten Passwortes und Usernames durch Dritte, wie auch für jeglichen durch Nichteinhaltung der oben genannten Regeln entstandenen Schaden für Paolo Della Santa und/oder Dritte verantwortlich und verpflichtet sich ab sofort, Paolo Della Santa von jeder und weiteren Forderung, auch Schadensersatzforderungen, die direkt oder indirekt durch den oben genannten Gebrauch oder Missbrauch entstehen, schadenfrei zu halten.
